Our client was dismissed during his extended probationary period. Our client therefore had 4 months service with the Respondent before he was dismissed for alleged poor work performance.
The matter was referred to the CCMA for an unfair dismissal. Conciliation failed and we referred the matter to Arbitration.
The Commissioner granted an arbitration award in favour of our client and declared the dismissal of our client to be both procedurally and substantively unfair. The Commissioner ordered the Respondent to pay our client R 216 666.68. The Respondent brought an application to review the arbitration award to the Labour Court and the matter is pending.
